Filing for Bankruptcy in Chicago
When you hire us to assist you with a personal bankruptcy filing, our first step will be to determine whether you qualify to permanently discharge debt under Chapter 7 or Chapter 13. Under the 2005 revisions to the bankruptcy laws, you must submit to a means test to establish eligibility for Chapter 7. We will walk you through this test and then recommend a course of action.
After we have decided which approach is best for you, we will gather all necessary information on income, assets and liabilities. We will ask you to bring two years of income tax returns for Chapter 7 bankruptcy and four years of returns for Chapter 13. Generally speaking, we will also require six months of evidence of income. Based on all the information we obtain, we will prepare and file your bankruptcy petition.
Once your application has been filed, we will become your liaison with creditors, the court and the bankruptcy trustee, attending all meetings or hearings, and acting as your advocate. As a general rule, we will speak on your behalf at all times. There will be no personal confrontations. Nonetheless, we will prepare you in advance for any meeting, so that you know what to expect.
